1. Agreement

By creating an account or using asenati.com, you agree to these Terms of Service, our Privacy Policy, and Legal Disclaimer.

2. Platform role

Nivram Innovations operates Asenati as a technology marketplace that connects clients with independent lawyers in South Africa. Asenati is not a law firm, does not practise law, and does not provide legal advice, legal representation, or legal opinions.

Platform content, guided intake, classification, matching, pricing, notifications, and support messages are provided to operate the marketplace and should not be treated as legal advice from Asenati.

3. Eligibility and accounts

You must be at least 18 years old and able to enter binding contracts. You are responsible for keeping your login credentials secure and for activity on your account. We may suspend or terminate accounts that breach these terms or applicable law.

4. Lawyer relationship

When a lawyer accepts and conducts a consultation, legal services are provided by that independent lawyer, not by Asenati. Any attorney-client relationship exists only between the client and that lawyer, subject to the lawyer’s professional obligations under the Legal Practice Council and applicable rules.

Submitting a request, paying, or being matched does not guarantee that a lawyer will accept the matter or that the consultation will lead to ongoing representation. Lawyers may decline or stop assisting where there is a conflict of interest, lack of availability, lack of expertise, or another professional reason.

Lawyers on the platform must maintain accurate profiles, valid LPC registration where applicable, and verification documents as requested. Asenati may verify credentials for platform access but does not guarantee outcomes of any matter.

5. Consultations and conduct

Clients must provide accurate intake information. Consultations may include chat and video. You must not use the platform for unlawful purposes, harassment, fraud, or to share content that infringes others’ rights.

A fixed-price consultation is for initial advice and guidance. It does not automatically include court representation, document drafting, correspondence, filings, appearances, or ongoing retainer work unless separately agreed directly with the lawyer.

Asenati is not an emergency service. For arrest, imminent court dates, or immediate danger, contact emergency services or a lawyer directly.

6. Payments, fees, and refunds

Consultation fees are quoted before payment and collected through our payment partner (PayFast) before dispatch to lawyers. Platform fees may apply as shown at checkout.

Refunds may be issued where a consultation was not delivered as agreed, subject to our in-platform dispute process and review of payment and session records. Chargebacks without first using the dispute process may result in account suspension.

Lawyer payouts are processed after consultation completion and admin approval, as shown in the lawyer earnings area.

7. Disputes

Clients and lawyers may open disputes regarding service delivery or billing. Asenati will review disputes operationally; our decision on refunds is not a court ruling. You may still pursue legal remedies outside the platform where permitted by law.

8. Intellectual property

Asenati’s software, branding, and content are owned by or licensed to us. You retain rights in content you submit but grant us a licence to use it to operate the service (matching, support, disputes, and compliance).

9. Limitation of liability

To the fullest extent permitted by South African law, Asenati is not liable for the quality of legal advice, case outcomes, or indirect or consequential losses. Our total liability for platform-related claims is limited to the fees you paid for the relevant consultation in the preceding 12 months, except where liability cannot be limited by law (including under the Consumer Protection Act where applicable).

10. Changes and contact

We may update these terms by posting a new version on the site. Material changes may be notified by email or in-app notice where appropriate.

11. Governing law

These terms are governed by the laws of the Republic of South Africa. Courts in South Africa have jurisdiction, subject to any mandatory consumer protections.
